Crime is subjective and objective at the same time since not all societies employ the same rules and regulations , it can be subjective as to the interpretation and culture of that society . For example , in the Igorot tribe in the Philippines , killing someone who had wronged your family is accepted as

long as no one complains , unlike here in the United States , even if no one complains , the State would prosecute the suspect in behalf of the victim or the victim 's family . Crime is objective since in most societies , there exists a firm law against wrongdoing of any sort and with it a corresponding punishment . This applies to all members of that society
As per dictionary , a criminal is someone who has committed or been legally convicted of a crime . They are the people who deviate from the society 's norms and deserve castigation , and reprimand for their misdeeds . They should be separated from the greater good to reduce additional harm while they are serving their sentences . However , while incarcerated , how should they be treated
In the United States , criminals range from juveniles to senior citizens girls , women , boys and men , are taken into jailhouses , correctional houses and juvenile detention houses for rehabilitation and /or to serve their sentences . These individuals had done the society and its members wrong and they are paying for their crimes through staying in prison The behavior towards them is again , subjective , as per the jail officer 's biases but according to the Constitution of the United States , Bill of Rights , under the Eight Amendment - protection of the convicted criminal from cruel and /or unusual punishment
Suffice to say , that even convicted criminals have rights as declared by the Constitution , and direct or indirect violation of it is punishable by the law . It is a fact that there are people who detest criminals and completely has no regard for them . For some people , criminals are the scum of the earth and they do not deserve a humane treatment as they did not respect the humanity of those they did wrong . Therefore , in some states , or penitentiaries , or even in Congress , a convicted criminal 's situation and plight in prison is insignificant and need no further attention
Thus , enters , human rights advocates who claim that convicted criminals are , still , human beings , and deserves the compassion and kindness , as one person would bestow to a non-criminal friend
However , a question hangs , with so many spectacles , with trials and juries and appeals , are the methods used (good or bad ) in treating criminals effective ? Effective for whom ? Does the end justify the means
