Limitation of the Power of Government

It was the Founding Fathers of the United States Constitution who designed the vehicle by

which individuals could have such rights as life , liberty and property Hornberger stated that , there

are two major purposes of the Constitution , and these are to call the establishment of a government

and the assurance that the powers of that government must be limited ( Liberty and Constitution

In fact , citizens of the country firmly believed that rights emanate from the mandates of the

government when in

fact and in truth , liberty precedes governance as pointed out by the founding

fathers ( Liberty and Constitution . Hornberger continued to say that , it was expressed in the

constitution those specific governmental powers so well-defined of which there are also restriction

of the said powers ( Liberty and Constitution . Thus , the founding fathers believed that the goal of

the Constitution is for the state to achieve a peaceful and harmonius society and that the

government 's intervention with respect to human freedom must be prohibited ( Liberty and

Constitution

Findlaw gives the examples of Constitutional features which limits the powers of government

are right to religion , right to speedy and public trial , right against self-incrimination in criminal

cases and right against double jeopardy ( United States Constitution . The right to religion affirms

the reality that piety , religion and morality are factors that will affect the well-being of the society ( Liberty and Constitution . The right to speedy and public trial is very important because it will

end the anxiety felt by a person suspected as a criminal and ensure him that justice will be rendered

in due time . Besides , no one should be forced to testify against himself as it would be adding insult

to injury . Finally , no one should be put to trial for the same offense with the same penalties twice .PAGE 2
