Legal and Ethical Issues

The distinction between the grounds and the force of law seems to suggest , along with the positivists , that it is one thing to say what the law is on some matter , quite another to say whether it has any moral merit and therefore any call upon our respect and our obedience . The force of law may , in some rare instances , be so weak as to license a refusal to comply in the face of morally deficient law , one should obey punctually and censure freely (Cohen , 2001 ) One in no

way seeks a conceptual separation between the law and its force , between the grounds of law and its moral force in justifying coercion (Bradshaw , 1990

The legal philosophers rightly concentrate on the grounds of law , while political philosophers are typically concerned with questions of its force . It is nevertheless view that a plausible legal theory regarding the grounds of law will inevitably entail a fairly general answer to questions about what one might call the 'non-exceptional ' or 'normal force of law . A legal-grounds theory does not perform its adherents to concrete claims about what one should do , but it does nevertheless commit us to general moral conclusions about how citizens should behave and how judges should decide cases (Burckhardt , 1986 ) Unless a legal-grounds theory is an intensely skeptical one , which accords absolutely no justification for obedience or state coercion 'it must be understood as saying what judges should do in principle , unless circumstances are special (Fox , 2000

The medical profession often claims that its ethical norms are unique that only members of the profession can know and live by them , that this special professional ethic is not capable of being justified in universal ethical principles . Others argue that the private ethical positions of a professional group should not be morally binding on nonprofessionals . But medical ethics does not encompass solely the ethical opinions of physicians . It comes also from religious philosophical , legal , and social scientific sources (Booth , 1992 ) It is expressed not only in the codes of the medical profession , but also the guidelines of government agencies

A lot of employees while working in Clinical organizations face ethical as well as legal situations . In some cases it is considered the legal responsibility of the nurse and doctor to tell the patient about the patient 's serious illness that can lead one to death . The nurses and doctors face the ethical aspect of it as well that this news can damage the moral of the patient to live and struggle for life
