The ADA is a justice /fairness /equality law for people who are suffering from disabilities , and who are guaranteed protection from discrimination by law in state and local government employment in the use of public accommodations ' and in employment , which is to say that employers are urged not to make their hiring , firing and managerial decisions based solely on their potential or present employees ' health status in all disability cases . The ADA also protects the disabled people from discrimination in the use of public transportation and telecommunications , according to the U .S . Department of Justice , Civil Rights Division , Disability Rights Section . The governmental department further provides information on its website about the kinds of laws covered by the ADA . The foundation of these laws is the definition of disability ' According to the U .S . Dept . of Justice , a disability is a mental or physical impairment which has the capacity to significantly limit life activities , including the ability of a healthy person to take care of himself or earn his bread .
