Several times employers intentionally or unintentionally ask interviewees illegal questions . These questions are designed in such a way that employment decisions are made based on the interviewee s race

, age , gender , marital status , sexual preference , country of origin , ethnic background or other discriminatory factors . These factors do not help judge how a person will perform a job The best way to handle such questions is to firstly analyze the intention of the interviewer . These questions are usually asked in innocence or ignorance . The interviewer is not trained professionally in interviewing and is usually trying to be friendly to the interviewee by asking personal questions . If a candidate ascertains his or her constitutional rights it will make the employer /interviewer end the consideration for future employment . This could ruin the candidate s chances completely There are three options regarding such questions . The first option is to see whether the answer will not affect his chances and then the candidate should answer truthfully . The second option would be to notify the interviewer that the question asked is illegal . This means taking the risk of annoying him and ruining all possible chances for future employment at the organization . The third option is to answer the question based on the requirements of the job and the ability to perform it These are two illegal questions often asked by interviewers and the suggested responses to them One of the most frequently asked question is Are you married The question is mostly asked from women . It is asked in to assess whether the female candidate will be available incase of overtime or have familial obligations . Incase she is married the employer is worried that she might leave the job incase of a pregnancy . The employers also want to know if any time will be taken off to take care of a sick child To answer the question in a tactful way would be "I 'd prefer to answer questions related to the job rather than personal ones On the other hand a non-confrontational approach would require answering in the following way "Yes I am married . My work is extremely important to me . I make sure I give a 100 to my job and nothing at all interferes with it . I can work on weekends and travel whenever necessary Incase the candidate is not inclined to work 50 hours per week and cannot travel all the time than he /she should phrase a response in a way that they stay true to themselves
