The Americans with Disabilities Act of 1990 (ADA 1990 , in layman 's terms , is basically an Act promoting equality in 1 ) employment opportunities and 2 ) accommodations in public services for Americans specifically protecting those 43 ,000 ,000 who have disabilities . The ADA 1990 is part of the US Code under Title 42 (The Public Health and Welfare ) and is divided into two subchapters based on these two concerns Subchapter 1 prohibits employment entities from discriminating against qualified individuals with disabilities in job application procedures hiring , firing , advancement , compensation , job training , and

other terms , conditions , and privileges of employment (cited in www .EEOC .gov This means that the employer must accommodate applicants with disabilities so long as they are deemed qualified for the position they are applying for . It doesn 't mean , however , that a deaf man for example applying for a construction work should immediately be hired because he is protected by ADA 1990 . The employer , of course , has the right to screen all applicants in basis to the criteria required . But the ADA 1990 makes sure that the screening process is under no bias whatsoever against any applicant , especially those which have impairments . In other words , the Act doesn 't necessarily put persons with disabilities on an advantage . It just protects them on possible biases in the work place Subchapter 2 prohibits discrimination against persons with disabilities in terms of services given by a public entity , which includes any state or local government as well as any commuter authority...
