After almost fifty years of efforts , the dream of European Union was finally materialized in 1992 with the signing of Maastricht Treaty . It initially comprised of twelve member states which expanded to fifteen in 1997 and currently contains twenty five countries under its umbrella The formation of European Union enabled its member states to work under the concept of integrated European flag that allowed the opportunity of more freedom of movement to its citizens and enjoy the benefits of free trade

and commerce by providing a single market . In to explore its advantages and to work effectively in the best interests of all members the Union felt the need of some standardized legal procedures and codes which were acceptable to all . In furthering its objectives and mandate a draft constitution was prepared which was formally signed by its existing 25 member states in October 2004 . On January 12 , 2005 , the European Parliament voted in favor of the European Constitution by a heavy majority . This has been designed to evaluate the need for having a constitution , and analyzing its advantages and disadvantages especially for the European community . The will first highlight as to what a constitution is , followed by the need for the European Constitution . It will then scrutinize various events leading to the formation of the constitution and will then carryout its in depth analysis prior to concluding on salient aspects

What is a Constitution

A Constitution is basically a document which contains the fundamental rules of a State or a group of States . These rules define mandate of various institutions working under the State and describe working procedures of different governing bodies . It also highlights legal powers and duties of the State elements and dictates basic rights of the citizens . A constitution is merely not a written document but it 's a system which needs to be followed unilaterally by the whole segment of society which it effects . It 's application is not limited to a state or a group of states , it can be related to any organization , or a political party

A constitution is mandatory for setting rules and principles that define and regulate the relationship between various institutions and branches of the state which generally include the executive , legislature and the judiciary . Most constitutions also attempt to identify the relationship between individuals and the state , and to establish the broad rights of individual citizens . It is thus the most basic law of an area from which all the other laws and rules are hierarchically derived

Why a Constitution for European Union
