GUIDELINES FOR THE APPLICATION OF PATHOLOGY TO CRIME INVESTIGATIONS - QUESTIONS AND ANSWERS

PART 1

1 ) Generally , there are five manners of death used in forensic pathology to describe the circumstances of a death . List the five of them and an example of each

The five manners of death are natural , accidental , suicide , homicide and undetermined . A natural death is one that happens because of bodily disease or defect , such as a stroke or a heart attack . An accidental death is one that was not intended , such as the death of

a victim in an automobile accident or an airplane crash . A prominent recent example occurred when Vice President Cheney accidentally shot his hunting partner , and one of the pieces of buckshot that stuck the victim traveled to his heart . If the victim had died , this would have been an accidental death . Suicide is when a person takes his or her own life A prominent example of this is when Adolph Hitler killed himself at the end of World War II . A homicide is an intentional killing of another person . As discussed later in this , an example of a homicide is the death of O . J . Simpson 's wife , Nicole Brown Simpson . President John F . Kennedy 's death was a homicide . An undetermined ' death is one in which the actual cause of death cannot be determined . What caused Marilyn Monroe 's death is still being discussed . Undetermined death is also common with long-dead and decomposed bodies

2 ) Why is it important both legally and medically to know the time of death ? Provide an example to show your understanding of the legal implications

There are three main reasons : 1 ) the earliest determination of death for prompt harvesting of organs for transplantation purposes 2 ) the legality of discontinuation of life-supporting equipment and 3 ) the determination of the time of death in criminal and civil litigation

An example with legal implications would be if a husband and wife die together in a single accident and they have a will leaving everything to the survivor without a survivorship period of time stated . The will of the first to die would most likely leave everything to the other person Then the second person 's Last Will determines the ultimate distribution of the assets

In State of California v . Orenthal James Simpson , in which the Defendant was accused of the double homicide of his wife , Nicole Brown Simpson , and her alleged boyfriend , Ronald Goldman , the decedents ' times of death was one of the critical elements of the case for both the prosecution and the defense . In personal injury lawsuits , one of the major elements of damages claimed by the Plaintiff is the pain and suffering that the deceased endured between time of accident and death The time of death is used to determine this
