Those against the death penalty in cases where murder has been committed present two strong viewpoints . Firstly , the judicial system may end up convicting and executing the wrong person . Secondly , even if the correct person is convicted and executed , the loss of the victim is not recovered and the state merely repeats an act of murder instead of following its moral and religious duty to protect human life

However , considering judicial systems that are efficiently designed and provide a fair trial including

provision of resources to the accused the risk that a wronged person may be convicted is very low . In any case , even if the convict was given a life sentence to serve forty years in prison , and lets say after twenty years it is discovered that he did not do the murder , the courts can merely offer an apology as nothing can make up for his lost time and his tainted sense of self respect and self belief . Therefore , it can be argued that the risk that the wrong person might be convicted and sentenced to death is one that is low and cannot be eliminated . Its only mitigation is the efficiency of the legal system

Coming to the second point , although it is agreed that the state 's religious and moral duty exists to preserve human life and that killing the murder does not make up for the loss of the victim , it is the long term consequence of not killing the wrongdoer now that has wider implication for the state . Even if you don 't sentence him to death and as most abolitionists of the death penalty propose , sentence him for life , the risk that he may break out or commit similar acts in prison is high...
