Comparing and contrasting Australian legal system with Saudian legal system

Introduction

A legal system is a set of rules that are usually enforced through institutions and generally shapes politics , economics and society as well as mediate relationships between people . There exist different legal systems for different jurisdictions and each legal system elaborate rights and responsibilities in different ways . There are three major legal systems in the word today

namely : civil law , religious law and common law . The legal system in existence in Australia is English common law and Civil law in Australian civil code while that of Saudi Arabia is Religious law based on Islamic law but other secular codes have been introduced

Similarities

The two legal systems have principles of due process or procedural fairness . This principle encompasses equal treatment of all people before the law , that no person should be condemned unheard where defendants are treated as innocent until proven guilty beyond reasonable doubt . The two systems also embrace the principle of due process

They both define each organ of the state . In Saudi Arabia the system provides for a definition of each state authority namely : the judicial authority , the executive authority and legislative authority . On the other hand the Australian legal system provides for federal and state systems that incorporate the three arms of government as : the legislature , the executive and the judiciary
