Though Doug Champlin certainly does not hold any sort of ownership rights over the TBD-1 Devastator , he is most certainly owed for the salvage of the fallen war plane . If one looks at the reality of the situation , they can clearly see that he spent a huge portion of his own money to do a service for the United States Navy . That alone is reason enough for him to be reimbursed , given the fact that the Navy is set on reclaiming their plane

The U .S . Circuit

Court 's ruling is fair , as well . The rightful owner of the plane is the United State Navy , even though it was lost and abandoned . The problem with the entire ordeal is that the Navy would have had to expend their own resources to recover and restore the plane Since they plan on reclaiming it for use in their own museum , they would be gaining unfair benefits as a result of Champlin 's own out of pocket expense . With that in mind , it is extremely important to make sure that the man is repaid for what he has done for the federal government

In for the man to get his reimbursement , he needs to take up the action with the Supreme Court . They have the right , the power , and the jurisdiction to come to a ruling that is much different than what the Circuit Court might render . They might even feel the need to take a harder look at the portion of the constitution that governs the ownership of military things . They could find that an abandoned ship no longer belongs to the Navy , especially given the time frame and the circumstances presented in this situation...
