For last ten years or more , surge has been observed in tobacco lawsuits and smoking lawsuits . Since 1950 there is great increase observed in the marketing of these products in our society which cause injury and death to millions of people . In fact , around one of every five persons in United States die due to the injuries related to smoking . Such injuries include lung cancer , heart attacks , strokes and other disease

Smoking is undoubtedly very injurious for health in many ways depending on the intensity to smoke cigarettes . But the case which I

am going to present here went in favor of cigarette producing company because plaintiff failed to provide with the evidence which was essential to be shown in court to prove defendant guilty

Initially in this lawsuit Madison County Circuit Judge Nicholas Byron gave a verdict in 2003 , holding Philip Morris responsible for duping smokers to believe that light cigarettes were less harmful than regular cigarettes . In addition to being accused Illinois Supreme Court also made announcement that they would not rehear Price (plaintiff ) against Philip Morris . U .S Supreme Court also refused to rehear the case

Later on December 15 Illinois Supreme Court overturned their decision when plaintiff 's attorney Stephen Tillery d petition to reconsider the courts verdict . Sharon Price who was lead plaintiff and was police dispatcher at East Alton brought this class action lawsuit
