Federal property should not be treated as a form of private property since , by definition , a federal property belongs to the federal government and that it cannot be considered as a private property unless the Congress has so ed the abandonment of the federal property . In the case of collector Doug Champlin seeking a reimbursement for the payments incurred for restoring the Navy TBD-1 Devastator , Mr . Champlin cannot substantially argue that he claims the ownership

for the plane

Although the plane was abandoned in the sense that the entire crew did not return to the plane , it does not necessarily mean that the plane is no longer under federal property . Further , although there appears to be no indication that any efforts were made to locate the plane by the Navy , it does not necessarily correspond to the idea that there were no efforts at all

Since the Congress can only declare and that a federal property is already abandoned , even the Navy and certainly not Mr . Champlin can determine the `status ' of the plane as abandoned or not at least under legal circumstances . With this in mind , it can be maintained that the plane was not `abandoned ' under legal terms for the reason that the Congress has not issued an declaring that the plane has already been `abandoned . Hence , the plane , although spending a considerable length of time under the custody of Mr . Champlin , still belongs to the Navy which reiterates its status as a federal property

Therefore , it is substantial enough to maintain that the plane is still under the ownership of the federal government whether or not the plane has been located or has been under the custody of another individual With this in mind , it can be observed that federal property , although in some ways related to private property in the sense that there is the essence of `ownership , cannot be treated as a kind of private property whose ownership can be acquired by somebody else having custody of the property
