Fundamentals of Business Law According to the report the TBD-1 Devastator plane had been the only Devastator plane ever survived in the last World War . This gives the plane a great historical significant , needless to say , that it has a national importance and a relic that could tell our generation and those who would follow , what kind of aircrafts have been used in the World War , thus it can also serve as an educational tool and is highly rendered to be a publicly owned aircraft

The pane had survived the War since

it crashed in more or less eight miles from the coast of Florida . Doug Champlin , being an airplane collector and being the owner of a private airplane museum have did his best to recover the plane since for years there have seemed to be no interest as well as efforts in part of the Navy or the State as a whole to recover the plane

According to Mr . Champlin , he spent an enormous 130 ,000 .00 to be able to get the plane out of its wrecked position . Since he have spent this much , he claimed to be the sole owner of the plane , yet according to the Navy they are the rightful owner of the plane since it is a federal property , suggesting that it must be displayed in a National Museum in Pensacola Naval Base rather than in Mr . Champlin 's museum

The plane was obviously abandoned by the Navy since it was not given attention when it crashed in the years back then . This inattention might be rooted on the several problems that the entire United States faced back then when the war came to an end . However , its significance or its role in the war was also neglected despite the fact the all of its crew have survive the crash . Having this facts in mind , one cannot consider the plane to be lost , since there were living people or witnesses of its condition and its location

The plane cannot also be assumed to be just misplaced ' since it is neglected for quite a long time and there had been no efforts from the Navy or from the State concerning the plane up until Mr . Chaplin had claimed ownership

However , according to the Federal Laws and Regulations associated with shipwrecked ships and crashed planes , these kinds of facilities /utilities /properties remains to be owned by the Federal government . With this respect , the Federal Laws imposed a rule that any part of the wrecked material or property should not be disturbed by any private person whomsoever without authorization fro the government Following this statement , it is quite obvious that indeed , under the laws of Federal Laws what Mr . Chaplin had done was illegal

The Federal government have the right to impose special rules or laws regarding the issue , due to the fact that there is no private owner of Ship wrecked or crashed planes or any federal property in that case Federal property is government property...
