Statement of the problem

The recruiting and hiring practices of Ace Industrial have been put in question by the discrimination charges d against the company by Ms Gwen Hacker-Jones . It is by no means clear as to whether an incident of discrimination actually took place since the position applied for required a psychological orientation particularly suited to male workers . Currently there are no women working in the welding section Therefore , it would be difficult for a female employee to achieve a cultural fit . Additionally , the male applicant that was finally selected

had superior qualifications and also came highly recommended . The interviewing supervisor made his final decision based on these criteria However as perceived by Ms . Hacker Jones , the decision was made based solely on gender type without consideration to any other factors . This prompted her to charges with the Equal Employment Opportunity Commission . So now the company is facing an EEOC investigation

Key elements of the problem

The applicant was female who did not appear to have the same level of qualifications as another male applicant

The position applied for required a particular work ethic that would be more suited to male workers as the current organizational structure in the welding section consisted solely of male workers

There are currently no women working in the production teams . Therefore hiring Ms . Hacker Jones in this situation would adversely impact working relationships as current workers had created work ethics of their own

The company followed the practice of promoting from within . This ensured the process of a quick cultural fit and minimized the costs of training and development . In these circumstances , hiring Ms . Hacker Jones would mean that in the future she would have to be promoted to top positions in the production teams which as mentioned before currently had no women workers . This would once again have an adverse impact on the decision making process as the workers currently consisted of only men and the resultant cultural orientation which would contextualize the decision making process would be difficult to handle for a woman

The charges of discrimination may highlight the fact that currently the production teams consist of only male workers . The EEOC might view it as a violation of the Equal Opportunity Act

Stakeholder analysis

The Equal Employment Opportunity Commission is the most powerful stakeholder in this context as it has the power to initiate a lengthy litigation depending on the findings of the investigation . The company has to avoid litigation at all costs as it would create a negative image in the market . Currently the company enjoys a good reputation in the market as one of the top employers to work for in the state . That reputation would be tarnished . Therefore Ace Industrial has to resolve the situation keeping in mind the fact that any requests for information that may be submitted by the commission have to be immediately taken care of .
