The policy became a reality in 1972 when President Nixon called on the ninety-third United States congress to pass legislation on endangered species . The policy declared of the commitment towards conserving the environment and more importantly conserving endangered species and threatened species . It was successful and led to the formation of the convention of International Trade in Endangered species of wild Fauna and flora . Their greatest emphasis was to find ways to protect these species from diseases , destruction and more important was to check man 's interference as he carries out his daily activities

The government agency , corporation and citizens participated fully to give strength to this act . This was attributed by efforts to collect scientific data , putting plans or strategies to protect the species from predators and to significantly have safe and secure habitats . The scientific data was a major boost and was used to provide a list of endangered species and those that were threatened and a comprehensive report would form a basis for their strategic planning . Availability of habitats as well was a crucial consideration that would enhance supply of adequate and nutritional food that would stop the threat on existing species . Actions that would be harming , harassing or leading to death of species are a major concern as this forbid continued existence of some species

The Act contains a citizen suit clause that allows the citizens to sue the government to enforce the law

The law is enforceable under this Act for any deliberate violation or breaking of the law . Acts of trafficking endangered species without a permit can lead to heavy penalties including being jailed . Importing or exporting of such products without official permit from the authorised persons can be disastrous

In formation of the policy , there was a habitat conservation plan to involve landowners in this process of conserving the endangered species

Other law that are presented in the National Environmental Policy Act has enforced the enforcement of this Act . This provides federal agencies with an opportunity to critically analyze about the activities they are involved in and creating awareness on the environmental concerns . It is notably important to realize that environmental activities by man should maintain and enhance the long productivity of flora and fauna

The federal agencies are prohibited from giving authority or funds to facilitate actions that destroy critical habitats . On the other hand private and state lands do require a federal permit and have to go through the critical habitat regulation
