Running Head : MCDONALDS CASE McDonalds is Not at Fault : No Violation Name of Student School Professor Subject As the case present McDonalds at fault on many reasons , it should still be taken that it is not entirely the fault of the company McDonalds promised quality in their products , especially on the taste factor . This is to be asserted in their food and even in their signature beverages , including their coffee . In the case of Liebeck , she experienced third degree burns on 6 on her pelvic area . The coffee

when spilled , was absorbed by her clothing and stuck to her skin . This made it harder for her to escape from the scalding liquid
With all these factors considered , McDonalds should not be held accountable for something that could have been avoided from the beginning . As the evidence show , along with the facts lifted from the court cases , Liebeck should not have placed the coffee cup between her legs as she tries to remove the lid . She should have put it on a stable and safe table . She failed to think that coffee is hot , as it is commonly served . This means that regardless of the temperature that could be harmful on one 's skin , she should have thought of ways to avoid the burns
It was also argued that in any food establishment , food will be served at a temperature that is potentially scalding to the skin of any individual . Coffee is only among those food items . People should always think twice before handling hot food
Moreover , another source mentioned that the clothes she wore that day could also be part of the case . As it was mentioned in several articles that the sweatpants she wore that time absorbed the coffee and clung to her skin denied her of being able to escape the burns . It was written in the article , that if she wore clothes that were resistant to liquids that day then she would not have had the burns
In conclusion , McDonalds did not commit a violation . People should always think twice when handling hot food items . In addition , the clothes Liebeck wore that day could also be held liable . To ask a lower holding temperature is to ask McDonalds to lessen quality consumers are paying for
