According to Gelsthorpe (2003 , discrimination as compared to disparity may be difficult in defining it as in some occasion can mean showing good judgment . There can also be positive (favorable ) discrimination But in the criminal justice context , it is commonly taken to mean unfavorable treatment based on a person 's gender social class language race , ethnicity , religion sexual preference , age , disability or any other improper ground (Gelsthorpe 2003 pp 4 . Discrimination is associated with concept of prejudice , referring a particular group to be or people in the society to be inferior . For example , United States Criminal justice has been accused of regarding people of African American decent as difficult and associates them with crime than their counter part whites . Gelsthorpe (2003 ) asserts that discrimination in the criminal judicial system occurs as a result of law being permissive and individual discretion open . Can also occur in a situation where guidelines on how decisions are made are few meaning that the process of making judgment is made on subjective judgments
In criminal justice system , disparity is associated with the actual sentencing . In criminal circles disparity is mostly clearly associated with sentencing and the practice of giving different sentences for similar offences , but it is has wider relevance in terms of offender and victims being treated differently or unequally throughout criminal justice system (or related system ) when circumstances are similar (Gelsthorpe 2003 pp 4 . Criminal justice system as provided by the law is required to show sense that all are equal before the law of the land But when the disparity arises in the criminal justice system , justice is viewed as abstract and unable to give equality in the criminal justice system processes .
