It is imperative that counselors carry general liability insurance ,
primarily because of suits arising from malpractice . There are many
instances in which a counselor can be sued for malpractice , either
civilly , or criminally . Malpractice is defined as harm done to a client
resulting from professional negligence . Liability will be classified
under two headings , civil and criminal . Civil liability can arise when
the counselor acts wrongly towards their patients , or fails to act when
there is a duty to do so . Criminal liability concerns a wrong that
requires legal action . One way a counselor can be sued in a civil case
could be if the counselor does not follow the professional codes of
ethics outlined in the national Board of certified counselors
curriculum . Counselors must respect the confidentiality of their
patients , or else malpractice suits can arise . A second instance where
a counselor can be sued for malpractice would be when failing to act
when there is a necessary need to do so . For example , if the counselor
is helping a patient contemplating suicide and the counselor does not
let anybody else know and later the patience commits suicide a liability
suite could arise from negligence on the part of the counselor . Lastly ,
a counselor can be sued criminally , if any unlawful act is committed
between the counselor and the patient . For example , if the counselor
physically assaults a patient , criminal liability can arise . Certain
steps , a counselor can take to avoid such occurrences is one , purchase
liability insurance . Liability insurance will protect the counselor in
instances were negligence has caused civil liability hazards (Burgum
Anderson , 1975 Hopkins Anderson , 1990 . Another way counselor can
avoid such occurrences would be to learn what rights there clients have
and inform their clients of them . For example , it is important for a
minor to acquire consent from a parental guardian before entering into
any type of counseling situation , if this rule is not followed , criminal
liability suits can arise . Furthermore , the records of all clients must
be protected by the counselor . Client 's privacy is of key importance to
a counselor , as long as no illegal acts were committed . As a counselor ,
a client 's privacy should be of the utmost importance . If a client
feels that they cannot come to a counselor and speak in complete
confidentiality , the necessary trust factor between patient and
counselor will not be there . Accurate record-keeping is one of the top
five causes of legal liability occurrences . Records for counselors
contain all information about the client necessary for his or her
treatment . When counselors are dealing with their clients , it is
imperative that they follow the code of ethics set forth for them ,
purchase general liability insurance , and educate themselves on the
rights of their clients . Counselors do not have to worry about civil ,
or criminal liability , if they are well protected . By purchasing
liability insurance , the counselors protect themselves from any civil
liability that may occur , or criminal , depending on the peril . As long
