As a result , the First , the Fourth , the Fifth , the Sixth , and the Fourteenth Amendments do not provide the required balance between justice and security The Bill of Rights Introduction Throughout its historical

development , the American state has been in constant search for the proper balance between justice and security . The administration of justice and security presupposes meeting the requirements and criteria of public safety without discriminating the rights of those who live in and outside the United States . However , it appears that to promote security , it is often necessary to either break the law , or to discriminate the rights which are protected by the U .S Constitution . The question is , whether the state has the right to violate the basic provisions of the U .S . Bill of Rights in to protect the American population ? Unfortunately , the Amendments I , IV , V VI , and XIV do not give the answer to this question , and they actually create the need for re-considering the importance of human rights against the need to promote public safety and successful justice administration
Amendment I and the administration of justice and security "Congress shall make no law respecting an establishment of religion , or prohibiting the free exercise thereof or abridging the freedom of speech , or of the press or the right of the people peaceably to assemble , and to petition the government for a redress of grievances (Amendment 1 to the Constitution of the United States , 1791 . The First Amendment of the American Constitution is actually the law which protects the freedom of religion , speech , and press . However , do these provisions provide the required balance between justice and security They don 't , and the Constitutional provisions evidently lack the specific criteria which would determine the limits of the speech and press freedom , as well as the freedom of religion . When mass media are used for the declaration of violent intentions against the security and sovereignty of the United States , the American nation should have the right to restrict such freedom . From the legal viewpoint , there is an urgent need to determine the exact legal and social limits of religious freedom , as well as the freedom of speech and press
